This contract will serve as an order for photographic services by jclare studios, hereby referred to as "photographer." All parties will recognize the items listed in this contract as binding. No item(s) shall be modified unless agreed upon by the contracting party and photographer. This contract will be considered void if altered without the expressed consent of the photographer.
Copyright and Property Statement
a. All photographs taken by photographer or associates / representatives will remain the intellectual property of the photographer and those rights are reserved accordingly. All photographs created are protected by United States Copyright Laws.
a. (1). If the package purchased does include digital negatives of photos, the client is hereby given reproduction rights to those files. However, this release will pertain ONLY to personal use; reproductions for commercial or any other use for profit is strictly prohibited.
a. (2). Photographer is neither responsible nor liable for the color, cropping, or any other element of prints reproduced by client or client's representatives.
b. Any and all photographs taken by photographer may be used for photographer's commercial use, advertising, or promotional materials, including, but not limited to: online web portfolio, hard-copy portfolio, magazines, information packets, or brochures. For this purpose, this contract shall also serve as a model release.
Delivery of Goods and Services
a. If selected, photos on disk will be delivered approximately eight weeks after contracted services. All other products will be delivered when expressed by the photographer based on the estimates provided by third party vendors.
b. It is hereby understood that this photographer will be the sole photo booth photographer for this event. In the event that other parties prevent photographer from doing his / her job (other photographers, etc.); client releases photographer from any further obligation in covering the event, and photographer's fee shall be due in full.
c. Photographer will take every responsible means possible to protect the equipment, files and photos contracted, however, the client shall release the photographer from all liability in the event of lost photos due to natural disaster, including fire, flood, or other acts of God or other events beyond the photographer's control.
c. (1) In the event that the client's photos are lost or damaged, a full refund of all monies paid will be issued for those services not completed and delivered. Client releases photographer from any further liability.
Fees for Services
a. In order for the specified date to be booked and reserved for photography services, this contract must be signed by a representative of both parties and a non-refundable deposit of 50% of the package amount paid plus any applicable sales tax. The remaining balance shall be due no later than 10 days prior to contracted service date.
b. Failure to remit payment by the terms outlined above will act as cancellation of services and forfeiture of deposit.
